Under seven years: nothing is payable when your job ends.
Seven to ten years: you are paid a proportionate amount based on 8.67 weeks for ten years, about 0.87 weeks a year (s 8(3)). It counts your whole period of continuous employment, including months, weeks and days. Resignation, redundancy, retirement, illness and death all qualify. Only dismissal for serious misconduct does not.
WA government example: Riley resigns after eight years, four months and five days and is paid 7.24 weeks. The WA government calculator works from actual dates and gives 7.23 or 7.24 weeks depending on the dates, so small differences are normal.
After ten years the rule for the extra amount changes. You are paid any untaken blocks, plus pro rata for completed years only since your last block (s 8(2)(c)). Months and days after your last completed year are dropped. A dismissal for serious misconduct after ten years removes that extra amount completely (s 8(2)(c)(ii)).
Unpaid leave and other periods that do not count as service are taken out of your employment (s 6A(2)). That can bring you below seven years.
If you took leave in advance, it is deducted. In a WA government example, Liam took 8 weeks in advance at seven years and resigned at eight years. His pro rata was 6.94 weeks, so his employer could deduct the 1.06 weeks he had not earned (s 10).
Common questions
Do I get pro rata long service leave if I resign after seven years in WA?
Yes. Between seven and ten years you are paid pro rata for any reason except dismissal for serious misconduct (s 8(3)).
How is pro rata long service leave calculated in WA?
8.67 weeks multiplied by your years of continuous employment divided by ten, counting years, months, weeks and days. You are paid that many weeks at your ordinary pay.
Is pro rata paid if I am dismissed for serious misconduct in WA?
Not between seven and ten years. After ten years you are paid only the untaken part of your last full block (s 8(2)(c)(ii)).
