The state long service leave calculator does not apply to this scheme. If you are covered, your leave is worked out and paid by LeavePlus (CoINVEST Limited) under its own rules. Check your service record with the scheme.
Who is covered
- Workers, apprentices, working sub-contractors and worker directors doing construction work in Victoria.
- Construction work includes building, electrical and metal trades: reconstruction, renovation, maintenance, installation, repair and demolition, on site or off site in workshops and yards.
- Coverage applies regardless of award or union membership.
- A two-thirds rule applies if you do mixed work.
When you qualify
You need 7 years (1,820 days) of continuous service (Rules r 24.1). Service in an interstate partner scheme can be combined.
What you get
For service after 1 July 2002 you get 1.3 weeks per full year, which is 9.1 weeks after 7 years. Service before 30 June 2002 earns 0.866 weeks per year (6.1 weeks after 7 years). The rate is usually the average ordinary pay reported by your employer or employers. The minimum claim is 1 week (5 days) unless you are leaving the industry.
Leaving early, illness, retirement and death
- Leaving the industry or unemployed: you can get a payment in lieu only if you already have enough continuous service for a full benefit. That is 7 years wholly after 1 July 2002, 10 years wholly before 30 June 2002, or 7 years where your service is mixed (Rules r 38.1.1, r 24.1, r 24.3).
- There is no shorter leaving-the-industry threshold.
- If you permanently leave the industry or retire, your entire available balance is paid as a lump sum.
- Death: at least 55 days of continuous service, where the worker died on or after 1 July 2002 (Rules r 39.1).
- Terminal illness: at least 55 days of continuous service (Rules r 39.3).
How it is paid
LeavePlus pays you directly into your bank account in one payment. Tax is calculated at a weekly rate. If you have not given your tax file number, tax is taken at the top marginal rate.
How to claim
Claim through LeavePlus. Log in to the member portal at https://member.leaveplus.com.au/login. Claim at least 1 week (5 days) unless you are leaving the industry. Give LeavePlus your tax file number so you are not taxed at the top rate.
Before you rely on this
- Leaving the industry before 7 years does not give you an early payment. Only death and terminal illness have a 55-day threshold (Rules r 38.1.1, r 39).
- Service before 30 June 2002 earns at a lower rate (0.866 weeks per year).
- No tax file number means tax at the top marginal rate.
The scheme and its law

Common questions
How much leave do I get after 7 years?
For service after 1 July 2002, 1.3 weeks per full year, so 9.1 weeks after 7 years (Rules r 24.1).
Can I cash out if I leave construction after 5 years?
No. A payment on leaving the industry needs enough continuous service for a full benefit, which is 7 years for service after 1 July 2002 (Rules r 38.1.1).
Can I take a break from construction?
Yes. A break of up to 4 years is allowed without losing your service.
Does interstate work count?
Service in an interstate partner scheme can be combined with your Victorian service.
