The state long service leave calculator does not apply to this scheme. If you are covered, your leave is worked out and paid by Construction Industry Long Service Leave Board (SA Portable Long Service Leave - Construction Industry) under its own rules. Check your service record with the scheme.
Who is covered
- Most workers doing on-site building, electrical and metal trades work on new or existing commercial, industrial or domestic buildings or structures in SA.
- Apprentices, who are registered at no cost to the employer.
When you qualify
You need 2,600 service days, which is about 10 years full-time. You can earn at most 260 days per financial year.
What you get
You get 13 weeks after 2,600 days, then 1 week for each additional 200 service days. You are paid in advance at your average ordinary weekly earnings if an employer registered you in the last 12 months, or otherwise at an average industry rate. Leave is taken in whole weeks, with a minimum of 2 weeks.
Leaving early, illness, retirement and death
- A payment in lieu with at least 1,820 days of effective service (but under 2,600) where you have died (paid to your personal representative) (s 17).
- Or where you stopped construction work because of a physical or mental disability expected to stop you doing such work for 12 continuous months or more (s 17).
- Or where you stopped construction work and will not work in the industry for 12 continuous months or more (s 17).
- It also applies if you once had 2,600 days but now have under 1,820, or have 2,600 or more with leave not all taken (s 17).
- There is no retirement or age ground for employees. Retirement only applies to registered self-employed contractors and directors (s 37A(7)).
- A pro rata claim resets your service.
How it is paid
The fund pays you. Tax on leave is withheld using the PAYG weekly tables. Payouts on leaving the industry are taxed using the ATO tax table for unused leave on termination.
How to claim
Claim through the worker portal at https://portal.saplsl-construction.org.au/Public/Member. The scheme's 'Claiming long service leave' page explains the steps. Leave is claimed in whole weeks, at least 2 weeks at a time.
Before you rely on this
- The scheme's website and portal have moved to the saplsl-construction.org.au name. The older portableleave.org.au address now redirects for the portal.
- A pro rata claim resets your service.
- Retirement is not a ground for early payment for employees (s 17).
