Black coal mining long service leave (Coal LSL)

If you work in the black coal mining industry, your long service leave comes from a national scheme, not your state Act. Coal LSL runs the fund. Your employer pays you through payroll and then claims the money back from the fund.

The state long service leave calculator does not apply to this scheme. If you are covered, your leave is worked out and paid by Coal LSL (Coal Mining Industry (Long Service Leave Funding) Corporation) under its own rules. Check your service record with the scheme.

Who is covered

  • Eligible employees of national system employers in the black coal mining industry, including full-time, part-time, casual, contractor and job-agency employees.
  • Your duties must be directly connected with the day-to-day operation of a black coal mine, or carried out at or about a black coal mine.
  • People permanently employed with a mine rescue service.
  • Prescribed persons.

When you qualify

You need 8 years of qualifying service.

What you get

Full-time employees get 455 hours after 8 years of qualifying service. Leave builds up every week, before and after 8 years: 13/416 of your working hours (capped at 35 a week) for each week of qualifying service (s 39AA). For a full-time employee that is 13 weeks for every 8 years. Part-time and casual employees build it up in proportion to their hours.

Leaving early, illness, retirement and death

  • Leaving for any reason: untaken accrued leave is paid on written request (s 39C).
  • Ill health, or retirement from the black coal industry at 60 or over: payment for all qualifying service not yet giving an entitlement, with no minimum period (s 39CA).
  • Redundancy: at least 6 years of qualifying service (s 39CB).
  • Death: untaken leave plus all qualifying service not yet giving an entitlement, with no minimum period, paid to the legal personal representative (s 39CC).
  • Resignation needs 8 years (the full entitlement).

How it is paid

Your employer pays you through payroll, then claims reimbursement from the Coal LSL fund, which is funded by a compulsory employer payroll levy. Coal LSL pays you directly only if your employer is insolvent or has ceased to exist. On leaving, your employer must pay within 30 days of your written request.

How to claim

Your employer pays your leave, so apply through your employer in writing; leave must be taken in periods of at least 14 days, and your employer must reply within 14 days (s 39AB). When you leave, make a written request for payment; your employer must pay within 30 days. To check your service, use the Coal LSL Self-service Portal (https://portal.coallsl.com.au/portalclient/), the 'Request my leave balance' form, or phone 1300 852 625.

Before you rely on this

  • Resigning before 8 years gives no payment, unless another ground such as ill health, retirement at 60, redundancy (6 years) or death applies (s 39C-39CC).
  • Payments on leaving are made on written request. Put your request in writing.
  • Your entitlement is counted in hours (455 for full-time at 8 years). The estimator above shows weeks for a 35-hour full-time week; part-time and casual figures will be lower.
  • Service before a break of 8 years or more out of the industry no longer counts, unless you were already entitled (s 39A(4)).
